UK Updates Criminal Record Check Guidance for Visa Applications

There are new major guidelines on criminal records checks with consular officials for visa and overseas employment and voluntary applications effective from 11 December, according to the UK government. The above-mentioned changes will help improve security, compliance with the UK Immigration Rules, and process clarity for applicants and employers.

Main Updates:

  • Mandatory Checks in Health and Education: The sectors are obligated to conduct criminal record checks on job applicants with overseas experience but do not have to meet the requirements in other sectors as it is just best practice here.
  • Visa Applicant Requirement: Has criminal record certificates from every country where he/she has lived for 12 months cumulatively over the last ten years under this specific type of visa, such as the Skilled Worker route. This applies even to dependents of applicants.
  • Criminal Record Certificates: The ACRO Criminal Records Office will issue police certificates for individuals whose requirement is to show their criminal record status within the UK. An International Child Protection Certificate (ICPC) involving both UK and international checks can be obtained for such roles that involve children.
  • Missing Certificates Handling: Applicants who cannot get a criminal record certificate must show proof of having tried to get one. Otherwise, an explanation about not providing it must be valid, or the visa will not be given.

For 2025, there are implications in that applicants under this route will also have more time to prepare for their application since it will be introduced in that year. Applicants from countries with less intense criminal record systems may also face complex issues, while employers will be required to shoulder more and more responsibilities in terms of clear and enhanced safeguards for the vulnerable.
