During the hearing regarding the appointment of a judge in the Peshawar High Court (PHC), a six-member constitutional bench of the Supreme Court (SC) dissolved under the headship of Justice Aminuddin Khan.
This step had been taken on the basis of the concern raised by Justice Musarrat Hilali with regard to the participation of two members of the Judicial Commission of Pakistan in the proceedings.

Justice Jamal Ahmad Khan Mandokhail further raised critical questions regarding whether the Judicial Commission had reviewed it after objections from the parliamentary committee.
In this regard, the bench concluded that the matter needs further consideration and ruled that it shall be constituting a new bench for the purposes of dealing with the matter completely.
